The game What Is This? is offered by Dipl.-Ing. David Ammer, trading as Ammerbrothers, Waldstraße 6, 4642 Sattledt, Austria (“we”; details in the legal notice). These terms apply to your account, to playing online and to purchases in the game.
You need an account only to play online. You must be 16 or older to create one. One person, one account. Keep your password to yourself.
If not enough players are online for a quick match, computer-controlled players join in.
Drawings you make in Play Online are shown to other players so they can guess them. Copies of your drawings from Play Online, from classic games with friends and from local classic games played while you are signed in are used, without your name, to improve the drawing-recognition AI built into the game. You can switch this off in Settings with “Help train the AI”. Drawings from games with friends are deleted from the game after the game. Drawings you make in any other offline mode, or while you are not signed in, stay on your device and are never uploaded.
By uploading a drawing you grant us permission to show it to other players, to display it in the Hall of Fame if you publish it, and to use it as training data for the game's AI. You keep ownership of what you draw.
The permission to use a drawing as training data continues after you delete your account, for the stroke data that is kept then without your name (see the Privacy Policy). You can object to the use of your drawings for AI training at any time, and you can have the kept stroke data erased; the Privacy Policy explains how.
There is no tolerance for abusive content or abusive behaviour. Do not upload drawings and do not send chat messages that are hateful, sexual, threatening, or designed to harass another player. Nothing you draw, write or choose as your display name may be illegal or infringe other people's rights. Do not spam, cheat or attack the game.
Every player can report a drawing, a chat message, or a player, and can block another player so that their messages and drawings never reach them again. Each account can make up to 30 reports a day. Reports are reviewed.
Anyone, with or without an account, can also tell us about content in the game that they believe is illegal, by email to support@ammerbrothers.at (Art. 16 DSA). Please say which content it is, as exactly as you can (for example the drawing's word and where you saw it, the player's name, or the room and time of a chat message), explain why you believe it is illegal, and confirm that you believe in good faith that your notice is accurate and complete. Your name is optional. A person reviews every notice.
So that harmful content disappears quickly, some steps happen automatically, before a person has looked. A report only counts towards them if the player who made it was actually shown the content (a drawing they guessed, rated, saw in a room they played in or opened in the Hall of Fame; a chat message or drawing of the reported player that they saw), if their account was at least 7 days old when they reported, and only for the first 20 reports they make within 24 hours.
A word filter replaces offensive words with *** in chat messages, in the titles of drawings in the Hall of Fame and in Free Draw, and in guesses that other players see. It also refuses offensive display names and, in a room with friends, leaves offensive words out of your own word list. The filter works automatically.
A person reviews every suspension, usually within 7 days, and decides whether to lift it or to ban the account. Automatic hides and mutes are reviewed too, and a person can undo them. An automatic mute ends by itself after 30 days; a mute a person decided lasts until it is lifted. Only a person can ban an account. When content or an account breaks these terms or the law, we can hide or remove the content, mute the account, suspend it from online play, or ban it (a banned account can no longer sign in). We choose the step that fits how serious the violation is and how often it happened.
If one of your drawings is hidden or removed, or your account is suspended or banned, we email you a statement of reasons (Art. 17 of the EU Digital Services Act, DSA), provided your account has an email address. Several decisions are collected and sent together, at most one email per hour. The email says what we did, why (which rule of these terms, and how many reports there were), and whether the decision was made automatically. It does not say who reported you. We also email you when such a step is lifted.
A mute is not emailed. Instead, when you try to send something to other players, the app tells you that you are muted, since when, until when and why, whether it happened automatically, and how to object.
If you think a decision is wrong, reply to the email, write to support@ammerbrothers.at, or use Send feedback in the game's settings. A person looks at the decision again, and we tell you the result. You can also turn to an out-of-court dispute settlement body certified under Art. 21 DSA, and you can always go to court.
If you tell us about illegal content by email, we confirm that your notice arrived and tell you what we decided.
The game is free and shows ads. When you play on your own or in a quick match, your first game is free, and another free game is ready one hour after you used the last one. Every other game starts once you have watched a video to the end; otherwise you wait for your next free game. Games with friends, on the same Wi-Fi or online, start without a video; an ad is shown when such a game ends or when you leave it early. With VIP there are no ads.
VIP is a monthly subscription. While it runs, you get: no ads, also for everyone in a party you host; a crown on your avatar and a golden name; every pen colour and size; and your own word lists for Classic. The shop can also offer single items, such as an avatar; the shop shows what an item gives you before you buy it. You need an account to buy.
VIP and items are bought, billed and paid for through Google Play or the App Store, under that store's terms; the store shows you the price before you buy. A VIP subscription renews automatically every month until you cancel it. You cancel it in your Google Play or App Store account, in its subscription settings, not in the game. Deleting your game account does not cancel a store subscription: the store keeps billing you until you cancel it there.
A purchase belongs to the store account that paid for it. It counts for the game account you are signed in with when the game checks it with the store; with Restore purchases you can move it to another game account. When you delete your game account, VIP and your items end on that account. If we ban your account, VIP and your items end on it as well; please cancel the subscription in the store.
Right of withdrawal. As a consumer in the EU you generally have a right to withdraw from a contract made online within 14 days. For purchases in the game this means:
Apart from that, refunds are handled by the store under its rules. Your statutory warranty rights are not affected.
You can delete your account from the Profile screen at any time; how, also without the app, is explained on Delete your account. See the Privacy Policy for exactly what that removes and what is kept.
We can end your use of online play, or delete your account, if you seriously or repeatedly break these terms or the law (see “Reports and moderation”). A person always decides this, and we tell you why by email if your account has an email address.
We may change these terms, for example when the game gets new features or the law changes. The version in force is shown at the top. When we change them, the app shows you the new terms and asks you to accept them before you play online again. If you do not accept them, you cannot continue to play online; you can still have your account deleted at any time.
We are liable without limitation for damage we cause intentionally or through gross negligence, and for personal injury. Otherwise we are liable under the statutory rules. Your statutory warranty rights are not affected.
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer and live in another country, you keep the protection of the mandatory rules of the law of that country. Which court is competent follows from the law: if you are a consumer living in the EU, you can sue us in the courts of the country where you live, and we can sue you only there.
If the language versions of these terms differ, the German version applies, unless the version in your language is more favourable to you.
This section applies only if you live in the United States, and to no one else. For you, it takes precedence over anything above that says otherwise, to the extent the law that applies to your claim allows it. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GAME, ITS ONLINE SERVICES, VIP AND ALL ITEMS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE SAME EXTENT, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, AND OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE GAME IS LIMITED TO THE GREATER OF WHAT YOU PAID FOR PURCHASES IN THE GAME IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND USD 50. Nothing in this section limits our liability for personal injury, or for damage we cause intentionally or through gross negligence. Some states do not allow the exclusion of implied warranties or the limitation of certain damages, so parts of this section may not apply to you.
Our single point of contact for players and for authorities (Art. 11 and 12 DSA) is support@ammerbrothers.at. Players can also reach us in the game with Send feedback in the settings. We communicate in German and English. Notices about illegal content go to the same address (see “Reports and moderation”).
